Lets get a sense of perspective here. We are, as yet, talking about one trader [b:1pdwndm7]giving away [/b:1pdwndm7]a bottle of home made wine with a €12 or more purchase of cheese. Where is the problem? Is this going to cause the closure of any pubs, retaurants or breweries? If one objects to such practices then report the bootlegger to the authorities and boycott the illegal trade in moonshine wine. Down with this sort of thing!

The consequences of breaking revenue and licensing laws are a whole other matter, and opinions vary. But the OP's question was solely on the legality.

I'm not condoning the non payment of duty. The wine is not being sold, it is given away to those who buy €12 or more of cheese. Is it any different to you giving some bottles of home brew away?

As I said if someone has a problem with the trader then just report him and boycott his stall.

PS has anyone objecting to this practice ever driven without road tax, broken a red light, broken the speed limit, parked on a double yellow, brought home extra booze/fags from the duty free? Just asking.

No-one is saying they have a problem with the guy and what he's doing,no-one is looking to snitch. All I gathered from the OP was that he was only inquiring out of concern for the cheese vendor and it would be a shame to see him get done by revenue for something like this.

And believe it or not, but go to any market in the country and ask the traders about revenue.
They frequent these places, it's not allways the big fish these guys are out to fry in fact its just as common they target the very small business
