Yes that is still excise though, we do not have to pay it since we do not sell our beer. It would be pretty unfair to expect us top pay excise for beer we have no way or no intention recover from a purchaser.

It would also mean we would be allowed to sell or home brew if it was true

Well, the exemption for private domestic use is pretty clear, so no duty on homebrew unless it is for non domestic use or offered for sale.
